Terms of Use of MyPass Ski services

  1. Ownership and management of the website/app/App

    (hereinafter simply referred to as “site/app” for the Web and “App” for the application) belongs to:

  2. Brief description of the services on offer

    MYPASS SCI is the service that allows access to the facilities of the conventioned areas, without having to go to the ticket office. MYPASS SCI allows you to ski freely, without having cash in your pocket or decide in advance which ticket to buy.
    MYPASS SCI technology, based on the time actually spent on the slopes, automatically detects the most convenient rate among those ones agreed with the ski area (see the details of the rates on the dedicated site/app pages), and charges the corresponding amount directly on the credit card, without any surcharge fee (smart billing).
    If you ski for several days consecutively, each day you will be charged the difference of price to reach the corresponding multiple-day rate.

    On the site/app is offered the “MYPASS Card”, that allows the use of services based on Freedom to Access (FTA) technology, aiming to make it easier for the registered User to access electronic checkpoints of the conventioned structures, allocated in the ski areas listed on the site/app.
    The site/app also offers complementary and instrumental services for leisure (useful information about the ski areas).

  3. Adhesion to these Terms of Use

    By registering on the site/app, the User accepts and agrees to comply with these Terms of Use, which can be consulted at any time on the site/app.

  4. Services on offer

    The site/app offers different levels of usability, according to the User’s needs, namely:

    1. Registration (free) : simple access to the site/app, or to each commercial site/app belonging to the MYPASS SCI circuit (ski areas, chalets). The registration, and use of the services related to it, is free.
      This functionality is dedicated to the User who wishes to be able to access the site/app, with the sole purpose of benefiting from the complementary services available on the site/app.
      It is necessary to carry out the Registration Procedure, adhering to the Privacy conditions, and providing the site/app with the User identity, and a contact e-mail address indicated by the same User, as well as with the additional data required by the Procedure itself.
    2. Purchase of MYPASS Card and use of payment services : request and activation of the “MYPASS Card”. This functionality is dedicated to the User who wishes to request one, or more, “MYPASS Card” on the site/app. The service is active
      only for the conventioned facilities, indicated on the site/app.
      Once the request has been made on the website/app, for one or more “MYPASS Card”, these latter will be sent to the User by ordinary mail, at the address indicated and registered by the User.
      The Cards may be also withdrawn at the cash desks of the conventioned ski areas.
      MYPASS Cards can also be collected at the sale point of certain operators, appropriately conventioned with MYPASS.
      To access the services, the User must register him/herself on the site/app, providing all the required data, including credit or prepaid card , that the User intends to use for the payment of the used services; the credit or prepaid card data is transmitted directly from MYPASS to its Banking Partner, that is responsible for their management.
      MYPASS therefore does not keep credit or prepaid card data transmitted by the User.
      About the processing, by MYPASS, of the data transmitted by the User, see the following Section 16 of these Terms of Use.
      In order to know the economic amount requested by MYPASS to its Users, see the item “Annual Fee” in these Terms of Use (Section 8), and the rates relating to each ski area, and reported on the site/app.
      In the following Section 5, the conditions for using reduced rates, if available in the chosen ski area, by minors and senior Users are reported.
      The presence of the User, who must show up at the entrances with the MYPASS Card, is detected by the electronic devices present at the access gates, using the RFID technology; then the User is allowed to access. The price of the access ticket to the structure corresponds to that one expressly shown on the MYPASS website/app.
      In the event of discordant information between the rates indicated on MYPASS website/app, and those ones reported by the Companies, in which access is performed, the MYPASS website/app will always be valid.
      The purchase of the skipass through the MYPASS service does not include any insurance coverage in favor of the User, or its assignees; however it is the User’s right to take advantage of the policies made available by MYPASS through the partner Company “HELVETIA Italia Assicurazioni S.p.A.” (hereinafter : HELVETIA), by means of a special agreement.
      The Section 6 shows the general conditions of adhesion to this voluntary insurance coverage.
  5. Minors and Senior Users: conditions and data processing.

    In order to make possible the use of reduced rates for certain categories of skiers (minors and Senior Users), it is necessary for the latter (in case of minors: a parent or guardian) to send to MYPASS the identification documents required by related the ski area.
    The detailed list of these required documents can be consulted on the website/app www.mypass.ski, with reference both to the specific ski area having an agreement with MYPASS, and to the Section 6.2 of these Terms of Use.
    Reduced rates, when available, can be applied only if all the documents expressly requested by the area in question are supplied to MYPASS, and shown on the site/app.
    The documents for non-senior adults are also requested by MYPASS, in case the conventioned ski area allows the use of multi-day subscriptions, e.g. from the 9th day onwards.
    MYPASS provides for the conservation and transmission to the partner Companies, managing the ski lifts, of the identification documents of minors and Senior Users, exclusively for the purpose of allowing the Service to be provided with the expected reduced rates, and in compliance with the prescriptions of its own “Privacy Information”, also available on the site/app.
    In any case, MYPASS discharges itself from any liability deriving from improper and / or fraudulent use by third parties, in relation to the data mentioned above, and this both in the year of the first registration, and for the subsequent ones, during which the mentioned registration will be in place.

  6. HELVETIA insurance Policy.

    1. General information
      Between the Companies MYPASS and HELVETIA, in anticipation, and for the entire duration of the ski season 2018-2019, the agreement was formulated, to provide MYPASS SCI Users with an insurance policy, to cover the skiing activity enjoyed in the ski areas conventioned with MYPASS .
      The policies can be activated only with daily validity.
      User adhesion to the insurance policy is completely optional.
      The User can take advantage of the insurance policy through the activation of the appropriate adhesion procedure; in addition, each individual User has the right to activate the insurance for more skiers, provided that the latter are included in their family unit, and present in his/her own account.
      The maximum age limit for the benefit of insurance is 70 years.
      There is also a progressive policy of discounts, in the case of use of several consecutive days of insurance coverage, to be automatically applied to Users who meet the required requirements.
    2. Operating modes
      The User (who can also not be identified with the skier), as already registered in MYPASS, will only have to complete her/his missing data, and provide, on the MYPASS website/app, or on the MYPASS SCI App, those ones referring to any other skiers subject to insurance coverage :

      • name, surname, birth date and place, sex, address, Tax Code;
        and also provide for:
      • filling the questionnaire,
      • signing the HELVETIA Information note;
      • signing the HELVETIA “Privacy Policy”.

      As a consequence of the Tax Code requirement, the adherence to the policy, and therefore the provision of insurance, will be usable only for Italian female and male citizens, and foreigners with residence in Italy, and therefore in possession of valid Tax Code.
      Upon receipt by HELVETIA of the above information, this latter will send the User the e-mail with the application form; the User must only fill it out, sign it, and send it to MYPASS for registration.
      The acceptance of the policy is concluded with what above described; on the other hand, insurance is considered activated as soon as the related daily payment is made, and confirmed.
      For this reason MYPASS will charge the amount of the credit card insurance of the User, as soon as the data of the first access through the gate is received, regardless of whether the insurance was activated on the same day or in the previous days.
      If the charge is not successful, the User will be notified by e-mail, and the insurance will not be stipulated, nor can it be in subsequent moments of the same day.
      Upon payment made and confirmed, the insurance will be provided: the User will receive an e-mail of MYPASS, which will have the value of receipt for payment.
      In case of missing communication, the User must contact the assistance of MYPASS, at the e-mail address: assistenza@mypass.cc or by calling the phone number: + 39 011 19116039.
      There will be no possibility for MYPASS to issue an invoice.
      HELVETIA will send an SMS in short times to the User, confirming that the insurance has been activated, for the period of interest of the User.
      The insurance will be valid until midnight on the day of activation, and will therefore also cover possible night skiing activities.

      Important: the activation of the insurance will not be allowed if the skier is already passed through one of the gates of the ski area, and therefore able to perform skiing activities.
      MYPASS is free from liability related to the non-activation of the insurance for technical reasons not attributable to its operating area, for example problems associated with the Internet connectivity in the ski area, malfunctioning of electronic access systems to the gates of the Companies managing the ski lifts, or other.

      Note : on the www.mypass.ski site/app the “HELVETIA Information Note” is available, on which the User can find all the conditions and further details concerning the stipulation of the policy offered by this Insurance Company.

  7. Services or performances for which MYPASS partners are responsible.

    Exclusion of MYPASS responsibility in the use of the services purchased.
    The sole responsibles for the correct functioning of the access gates to the facilities for which the MYPASS Card has been purchased, are exclusively the Companies managing the facilities themselves (in which the access gates are located), that provide this service, and the related performances, at their own name and on their own account, according to their own general conditions of use of this service by the public.
    MYPASS is not responsible for these services, and its role is limited to the correct use by the User of the chosen services.
    Consequently, MYPASS is not liable for any breakdown, inconvenience and damage in which the User should incur during the use of the services purchased on the site/app; in these cases MYPASS will try to do everything in its power to provide assistance to the User, who can contact via e-mail its Assistance Service at: assistenza@mypass.cc or call the phone number : 011 19116039.

  8. Annual Fee

    The Annual Fee for MYPASS SCI is € 15.00 (VAT included) for adults and € 10.00 (VAT included) for minors.
    The payment of the Annual Fee, which is the necessary condition for the activation of the services, allows the User to use this latter for 1 calendar year, starting from the activation. The promotions or conventions proposed by MYPASS will be published on the site/app, and may also include the discount codes on the fee, that MYPASS would activate, and which can be used by the User only once. In any case, the Annual Fee is not reimbursable, and is due regardless of the actual use of the services to which it gives access.
    The Annual Fee does not include:

    1. the price for the purchase of tickets,
    2. the price for any additional paid services that may still be present on the site/app, as offers dedicated to Users.

    MYPASS Card, included in the Annual Fee with related shipment, is granted on loan for free use, with the only obligation to return it at the end of the relationship, or in case of withdrawal. MYPASS reserves the right to ask the User for a refund of 5 euros, if it is necessary to issue additional MYPASS Cards for facts attributable to the User, such as in case of loss or damage.
    MYPASS will be able to send 2 cards, depending on the User’s choice to enjoy multiple ski areas, if these latter have different access technologies: this will entail an additional payment of 5 euros for the 2nd card.
    Any defective cards will be replaced, free of charge, by MYPASS.

  9. Payments and suspension of the service

    Any amount due to MYPASS, both for the Annual Fee, and for the services that the User is going to use, must be paid by credit card or prepaid card registered by the User. A confirmation of the charge and the related tax documentation will be sent to the User aregistered e-mail address.
    The amounts charged to the registered credit card will be collected by MYPASS and then paid to who is entitled (Companies managing the ski lifts, or the chalets, in the conventioned ski areas), under the terms and conditions agreed with the same Companies.
    It has to be specified that MYPASS charges to its Users only the amounts corresponding to the rates, for each ski area, indicated on the site/app.
    Upon registration, the MYPASS system sets the automatic renewal upon expiry of the requested services; it has to be specified that the User can at any time disactivate the automatic renewal of services, directly from the page of her/his User profile.
    If the automatic renewal is active, the User receives the notification of the expiration 1 month before, with reference to the initial registration date; 15 days before the expitration, the service will be automatically renewed, resulting in a charge of the Annual Fee.
    If the automatic renewal comes to be deactivated by the User, this latter receives successive notices of imminent expiration respectively 1 month, 7 days, and 1 day before the expiration: if the service is not manually renewed before the expiry, it will be suspended, until payment of the annual fee by the User.
    In any case, however, if the charge is not successful, the related service or purchase will be suspended, until the full balance of the amount due by the User.
    Any communication on this matter will be sent to the registered e-mail address.

    The service will also be suspended, upon communication to the registered e-mail address:

    1. in case of expiry of the validity of the credit card registered by the User;
    2. in case of non-payment or renewal of the Annual Fee,
    3. if the authorization from the issuing Institute, for the charges on the credit card registered by the User, is removed or denied,
    4. in case of violation of the prohibitions described in the following Section 11.

    In case of a 2nd unsuccessful debit attempt, a penalty of 5 euros will be applied for the eventual reactivation of the card.
    MYPASS reserves the right to definitively terminate the relationship with the User, in case of serious or repeated non-compliance, or inconvenience attributable to the User, due to non-payment.

  10. Termination of the relationship

    MYPASS can interrupt the relationship associated to the service, in all cases of ascertained violation of these Terms of Use, made by the User.
    The User has the right to unsubscribe from the site/app at any time, by sending a message to the following e-mail address: assistenza@mypass.cc
    The cancellation from the service can also happen from the App.
    10.1 Termination of the service. User cancellation
    Pursuant to the Legislative Decree 206/05, the User can exercise the right of termination, reported in the article 64 of the mentioned Decree, without any penalty, within the term of 14 days from the date of the activation of the service, by communicating it to the above mentioned MYPASS e-mail address.
    In case of termination of the service, or User cancellation:

    1. the Annual Fee eventually paid will not be reimbursed,
    2. the termination or cancellation will not lead to the extinction of payments still due for services purchased in the meantime;
    3. the relative charges will be made on the registered credit card, before the definitive termination of the relationship between MYPASS and the User.

    The User has the right to withdraw from the loan agreement relating to the MYPASS Card, by sending an e-mail to the above indicated address.
    The withdrawal from the loan agreement can be exercised at any time.
    The User has the right to disactivate the MYPASS service at any time, by sending a message from the registered address to the e-mail address: assistenza@mypass.cc or through special functionalities made available by the site/app.
    The service will be disabled within 48 hours of the request.

  11. Exclusion of refunds. Non-transferability to third parties of MYPASS Card, and purchased tickets.

    Any refund of the paid amount is excluded.
    It is alike excluded the reimbursement in case of accidental use of the MYPASS Card (for example if the User accidentally approaches the electronic devices nearby the access gates, even if he/she does not intend to use or purchase a daily ticket or other service incorporated in his/her MYPASS Card).
    In any hypothesis of approaching the electronic devices nearby the automatic gates:

    1. recognition will be immediate and inevitable,
    2. the User will be enabled for transit,
    3. the amount for the expected ticket, or other service incorporated into the MYPASS Card, will be charged to the credit, or prepaid, card registered by the User,
    4. it will not be possible to obtain the reimbursement of the service, even if not actually used.

    MYPASS Cards and tickets purchased through the site/app are owned by MYPASS and can not be cloned, altered or manipulated; moreover they are not transferable by the User to third parties. The registered User is the sole person authorized to use them for accessing the affiliated gates.
    MYPASS reserves the right to perform checks on the matter, and to suspend and / or disable access to the site/app or the service to the User in case of violation.

  12. Maintenance and malfunctions of the site/app.

    MYPASS reserves the right to modify, limit or exclude the accessibility and functionality of the website/app at any time due to maintenance work, implementation of new functions, updating, and similar events or needs. The data that should be lost or compromised will be requested again to the User in case of new access.

  13. Intellectual Property

    MYPASS and its assignees hold all the copyrights and all other rights related to the offered services, as well as to the contents of the site/app (such as, for example: information, images, videos, slogans, promotional material and communication).
    Therefore is expressly forbidden to modify, publish, reproduce or transfer them to any third party, as well as using them in a different way from the simple enjoyment of the same ones, by the registered User.

  14. Variation of the Terms of Use

    MYPASS can modify these Terms of Use at any time, including, but not limited to, the adjustment to a new issued legislation, or to adapt them to new and / or different services and functionalities, due to technical or service management needs.
    Any change in the Terms of Use will be reported to Users who registered when the previous Terms of Use were in force; the same Users will be asked to accept the modified Terms of Use; if these are not accepted, the User will no longer be able to access the site/app, or benefit from the services offered by the site/app.

  15. Relationship between the User and MYPASS

      1. Any communications concerning the relationship between the User and MYPASS must be sent to the e-mail address: assistenza@mypass.cc
      2. These Terms of Use are mandatory for the User, from the time of her/his application to the service.
  16. Partial loss of validity

    Should any of the provisions of these Terms of Use be, or become, no longer valid or ineffective under applicable law or judicial rulings, the validity and effectiveness of the remaining provisions will not be in any way affected.

  17. Personal Data processing (Privacy) and Cookie Policy

    As of the processing of Personal Data transmitted by the User, and the Cookie Policy implemented by MYPASS, please refer to the respective documents:

      1. “Privacy Policy”;
      2. “Cookie Policy”,

    present on the MYPASS website/app, and expressly dedicated to these matters.

  18. Applicable law and competent Court.

    These Terms of Use are subject to Italian law.
    For any controversy the sole Court of Turin will have jurisdiction.

Terms of Use MYPASS TORINO services

  2. Brief description of the services on offer MYPASS offers to its own registered Users :

    1. in “MyPass Torino” area in MYPASS site,
    2. or through the App “MyPass Torino”;

    the possibility of accessing to a range of services, including the payment of parking on the blue stripes of the city of Turin, hereinafter the “Service”. It is intended that the blue stripes are located on the roadway, so the service provided does not include payment of parking in parking structures (commonly called “autosilos”).
    Access to the Service requires the use of “smartphones”, on which the App “MyPass Torino” is available, and through which the Service is rendered.

  3. Adhesion to the Terms of Use

    By registering in the site, the User accepts and undertakes to comply with these Terms of Use, which can be consulted, and eventually printed at any time from the site itself.

  4. Operating methods of the Service

    1. To use the Service, the User can enter the same credentials (Username and Password) used to access his/her personal area on the MYPASS site, MyPass Torino section.
    2. The User is solely responsible for maintaining the secrecy of his / her credentials (Username / Password), and their use, whether authorized or not by the User.
      The latter is the sole responsibility for each of his/her activities carried out in the use of the Service, and undertakes to release MYPASS from any claim or demand relating to, or resulting from, the use or misuse of the Service.
    3. In relation to the above, the User undertakes to immediately communicate to MYPASS, via the website, or to the following address:assistenza@mypass.ccany unauthorized use by third parties of his/her credentials, or any other violation of which he/she became aware, committing however from now on to relieve MYPASS from any request, even compensation for damages, proposal and / or deriving, directly or indirectly, from the above indicated use or abuse by anyone.
    4. In case of loss or theft of the credentials to access the Service, or in cases where the User wishes to suspend the Service (and the related payment services), he / she must immediately communicate it to MYPASS through the site, or through the above mentioned help address. The User will be exonerated from the responsibility of paying any amounts validated by the Service, from the moment of receipt by the MYPASS of the above communication.
    5. The User may use the Service in association with the vehicles in his/her availability at the time of registration; if the User makes changes to the number plates on which he/she intends to use the Service, these variations can easily be applied by modifying the registration data to the Service.
    6. The User, after completing the registration to MyPass Torino, receives by e-mail the confirmation of registration, and the coupon that must, necessarily, affix on the dashboard of the machine, or in an adhesive pocket on the windshield, in any case in a position clearly visible from outside the vehicle, to indicate to the staff controller that he /she is using the MyPass Torino Service.
    7. MYPASS makes available to the User, both on the site and on the App MyPass Torino, the identification map for the parking areas codes, in order to allow Users to insert them in their own smartphone, and carry out the due payment.
      The map is made available at the time of starting the contractual relationship, and updated when a change occurs (tariff, area codes, other).
    8. To use the Service, the User must use the login credentials entered at the registration, and access the MyPass Torino, through which the Service is rendered. The User shall enter parking data (area confirmation, license plate, stay duration). Before confirming any operation of activation of the stay, the User shall verify and confirm the information shown by the system. The Service also allows you to extend, or end in advance the duration of the stay, and send specific notifications in relation to the duration and expiry of the stay itself. Before making the stay active, the User can always request the invoice to be issued; the latter will be issued upon completion of the stay, and sent by MYPASS via e-mail to the address registered in the User profile; in case of a foreign invoice being requested, the appropriate compilation of some specific fields will be required by the system.
    9. Should MYPASS verify that MyPass Torino Service is not enabled for a specific User, it will not issue to him /her the authorization to use parking facilities.
    10. In the event that the Service is temporarily unavailable, the User must provide for the payment of the parking fee by means of the authorized ticket office, or by the other payment instruments provided for, by the Municipality of Turin.
    11. In the event that the Municipality of Turin establishes a possible extension of the toll parking in one or more of the areas affected by the Service, MYPASS will guarantee, even in such periods and / or hours, the necessary assistance.
    12. The registration of all the stays made by each User can be consulted in the dedicated section of both the mentioned App, called “Stays Data Store”.
  5. Service Duration

    1. The User adheres to the parking payment service when buying the App MyPass Torino.
    2. The contract has a duration of 1 year.
      Expiry will result in the termination of the contract, that means of all the services included in the App purchased.
  6. Relationship with Users: charging and invoicing

    1. The application of the parking rate is the exclusive responsibility of the Municipality of Turin, possibly through third parties, delegated to do so by virtue of agreements with the Municipality itself.
      Processing of parking rates for the customer’s vehicles, on the basis of the criteria indicated by the said Municipality, is charged to MYPASS.
    2. The User is aware of the fact that the subjects referred to, in the previous point, may carry out specific checks on the regularity of the payment due for the stay, and raise administrative penalties (regulated by the Traffic Laws), if they should ascertain the non-compliance with the obligations of payment. MYPASS provides to the Users, in case of contravention of the Traffic Laws, the supporting data of the payment made, necessary to instruct the procedure of appeal towards the competent Judicial Bodies. The personnel in charge of the check will carry out the activity of ascertaining the regularity of the payment by checking that the plate of the staying vehicle is associated with a valid payment through the Service. In order to facilitate the work of the staff involved, the Municipality of Turin may request Users to display the coupon in a clearly visible position, as mentioned in the previous paragraph 4.6.
    3. The User expressly acknowledges that MYPASS is unrelated to the relationship between the User and the Municipality, or any persons who, on behalf of the Municipality, manage the parking payment system into the blue lines.
      Therefore, for any controversy deriving from said relationships, including disputes relating to the application of the fare / mode of use of the stay, and for the exercise of any related right, the User must exclusively contact the aforementioned subjects, remaining excluded from any liability MYPASS, even if the payments subject to the dispute have already been made.
    4. The Customer will only have to contact MYPASS in case of any anomalies in the payment of the stays, in case of disputes on the payments made, or in case of criticality arisen during the payment procedure of a stay. Any requests or appeals must be forwarded to the e-mail address: assistenza@mypass.cc or reported to the MYPASS Customer Service Department, operating from Monday to Saturday from 8.00 to 19.30, calling the number: 011 19116039.
      It is possible to get in touch with the Customer Assistance Service in the above specified working hours, in order to provide, in the event of breakdowns or malfunctions, the support necessary to resolve the anomalies reported, even by telephone, by the Users, within and no later than 8 hours.
      It is always possible to check the status of the active services and the amounts charged through the MYPASS site, after the login having been made, through his/her own credentials.
    5. The User, by joining the Service, agrees to accept the charge on his/her credit card, whose coordinates have been indicated at the time of registration on the MYPASS site, or on the App MyPass Torino, both of the Annual Fee (see the following paragraph 7.1), and of the stays amount, with the procedures and timing provided by GTT.
      The confirmation of the charge, and the relative fiscal documentation (receipt or, upon request, invoice) will be sent by MYPASS to the registered e-mail address, and to the User’s smartphone.
    6. With regard to the payment of the amounts of the stay, MYPASS makes available, in a dedicated section of the App, the list of the occurred transactions and of the receipts or invoices relating to the stays carried out, with the possibility to send them via e-mail, to the address registered by the User , or to make them visible, with the possibility of storing them, on the User’s smartphone, in printable format.
  7. Annual Fee and Service costs.

    1. The Annual Fee of MyPass Torino is equal to Euro 5.00 (including VAT), and offers Users access and payment via smartphone in different shops affiliated with MYPASS, including the stay on the blue lines; there is a free 14-day trial period from the date the credit card is entered.
    2. The Annual Fee represent only the possibility of access to the Service, and is to be considered as an additional cost, compared to the payment of the parking, which takes place according to the rates, for each area of the city, applied by GTT SpA.
      Any additional charges associated with the Service, which MYPASS intends to apply, shall be approved by GTT SpA.
    3. The amounts charged on the registered credit card will be collected by MYPASS and then paid to GTT, under the terms and conditions agreed between the two Companies.
      MYPASS charges its Users exclusively the amounts corresponding to the rates, for each area of Turin, applied by GTT.
    4. Upon registration, the MYPASS system sets up the automatic renewal of the Service, taking care to renew it before its expiry.
      The User can at any time disable the automatic renewal of services, directly from the page of his/her User profile.
      If the automatic renewal is deactivated by the User, the latter receives repeated warnings about the oncoming expiry : if the Service is not manually renewed before the expiry, it will be suspended, until payment of the annual fee due by the User.
      In any case, however, if the charge is not successful, the related service or purchase will be suspended, until the full payment of the amount due by the User.
      Any communication on the matter will be sent to the registered e-mail address.
      The User is also notified 1 month before by MYPASS about the expiry of his/her credit card, so as to make it possible to accomplish the renewal of the same, and therefore to not incur any possible infractions due to the expiry of the card.The Service will also be suspended, upon communication to the registered email address:

      1. if the validity of the credit card, registered by the User, expires;
      2. in case of non-payment or renewal of the Annual Fee;
      3. if the authorization by the issuing Institute for the charges on the credit card registered by the User is removed or denied;
      4. in case of violation of the prohibitions provided for in the following paragraph 9.

      MYPASS reserves the right to permanently terminate the relationship with the User in case of serious or repeated non-compliance, or inconvenience attributable to the User him/herself.

  8. Accounting documents and stays summary

    1. The information related to the stays performed will be made available to the User in the MyPass Torino area, on MYPASS site.
    2. MYPASS will not send hard copy documentation relating to the User’s stays. When the User requests to receive by e-mail the accounting documents related to the stays performed, and the relevant invoices issued by MYPASS, the latter will send him/her in electronic format both the analytical document and / or the invoice, with the details of the stays performed, and the related charges.
  9. Termination of the relationship

    MYPASS can terminate the relationship related to the Service, in all cases of ascertained violation by the User of these Terms of Use. The User has the right to unsubscribe from the site at any time, by sending an e-mail to the following address: assistenza@mypass.cc

      1. Termination of Service. User cancellation.

    Pursuant to Legislative Decree 206/05, the User may exercise the right of termination provided for by art. 64 of the aforementioned decree, without any penalty, within the term of 14 (fourteen) days from the date of activation of the Service, by communicating to MYPASS through the aforementioned assistance.
    In case of termination of Service, or User cancellation:

        1. the Annual Fee already paid will not be reimbursed,
        2. the termination or cancellation do not entail the termination of still due payments, for stays performed in the meantime,
        3. the relative charges will be made on the registered credit card, before the definitive termination of the relationship between MYPASS and the User.

    The Service will be disactivated within 96 hours of the request.
    MYPASS also reserves the right to interrupt the Service at any time, informing Users 60 days before the date of interruption, by communication in the personal area of the same ones, or sending an e-mail to the User’s registered address.

  10. Exclusion of refunds.

    Any reimbursement of payments made, or of Annual Fee paid for the use of MyPass Torino, even if not enjoyed, is excluded.

  11. Maintenance and disfunctions of the site.

    MYPASS reserves the right to modify, limit or exclude the accessibility and functionality of the site at any time, due to maintenance work, implementation of new functions, updating, and similar events or needs. The data that should be lost or compromised will be requested again to the User in case of new access.

  12. Intellectual Property

    MYPASS holds all the copyrights and all other rights related to the Service offered, as well as to the contents of the site (such as: information, images, videos, slogans, promotional material and communication). It is therefore expressly forbidden to modify, publish, reproduce or transfer it to any third party, like the use different from the simple enjoyment of the same ones, in the role of final User.

  13. Variation of the Terms of Use

    MYPASS may adapt these Terms of Use at any time, including, but not limited to, the adjustment to new regulations issued by the competent Authority, or to adapt them to any technical or managing necessity of the Service.
    Updated Terms of Use are always available on site, and on MyPass Torino.

  14. Partial loss of validity

    Should any of the provisions of these Terms of Use be, or become, invalid or ineffective under applicable law or judicial rulings, the validity and effectiveness of the remaining provisions will not be in any way affected.

  15. Relationship with MYPASS

  17. Applicable law and competent Court.

    These Terms of Use are subject to Italian law.

  2. Adhesion to the General Conditions

    By registering with the MyPass Venezia Application, the user accepts and agrees to comply with the General Conditions, which can be consulted at any time on the mypass.cc website or stored on their device.

  3. Services Offered

    The MyPass Venezia application allows the registered user to take advantage of various services and more precisely:

    1. Entry, payment and in some cases “skip the line” lanes in the affiliated facilities In order to use these services, it is necessary to carry out the Registration procedure by adhering to the Privacy conditions and providing the User with the identity of the User, a contact e-mail address, as well as any additional data required as part of the procedure including a valid credit card.
    2. The user, having selected the Museum or the service he wants to buy, must choose the date and type of tickets and select “buy”. It is also possible to book tickets and the same can be canceled according to the cancellation policies of each single museum. It is recommended to read it before proceeding with the purchase. Once the purchase has been made, a QR Code will be displayed at the entrance of each individual structure that will proceed with the relative demarcation.
    3. Entrance to the official parking areas of Venice Marco Polo Airport
      To be able to use this highly innovative service, the user correctly registered and with a connected credit card must approach the entrance gates of the car parks listed in the application, wait a few seconds to recognize their device from the column (without leaving the car) and authorize entry through the special button that is illuminated within the login screen. It is important to read the tutorial at the start of the application and have your own bluetooth and wifi enabled.
      The service is active only for the locations expressly reported in the application.
    4. Some services temporarily free for promotional choices, can be subsequently paid for the unquestionable judgment of MyPass and the fact that they were previously used free of charge by the user does not determine a right acquired by the same. Post-paid paid functionality

  4. Services or services to be paid by the MYPASS suppliers. Exclusion of liability of MYPASS.

    Debtors of the service for using access to places are the companies of the locations (where access gates are located), which provide this service and the related services in their own name and on their own account, based on their general conditions.
    MYPASS is not debtor of these services and its role is only to ensure that the user can properly use the services offered.
    MYPASS consequently does not answer for any disruption, inconvenience and damage in which the User should incur during the use of the goods or services purchased by the application; in such cases MYPASS will try to do everything in its power to give assistance to the User who can be contacted via email at the address assistenzaclienti@mypass.cc or by telephone number 011 19116039.

  5. Payments and suspension of the service.

    Any amount due, both for the Annual Fee (if provided) and for purchases / services that the User intends to make / use, must be paid by credit card / prepaid registered by the User. A confirmation of the charge and the related tax documentation will be sent to the User at the registered email address.
    The amounts debited from the registered credit card will be collected by MYPASS and paid to the right holders (sports facilities, art places, tour operators or other suppliers of goods and services available on the site) under the terms and conditions agreed with the themselves.
    The service is automatically renewed 15 days before its natural expiry. You can deactivate automatic renewal at any time directly from the user profile page; in this case, if subsequently it will not be manually renewed before the deadline, the service will be suspended until the voluntary payment of the annual fee.
    If the charge is not successful, the related service or purchase will be suspended, until the full balance of the amount due by the User. Any communications will be sent to the registered email address. The service or purchase will also be suspended, upon notice to the registered email address: in case the validity of the credit card registered by the User expires, in case of non-payment or renewal of the Annual Fee, if it is removed or denied authorization to debit the credit card registered by the User, or in case of violation of the prohibitions provided for in Article 8 (second paragraph). MYPASS reserves the right to permanently terminate the relationship with the User in case of serious or repeated non-compliance or inconvenience attributable to the User.

  6. Cancellation from the application. Withdrawal. Disabling the service

    The User has the right to cancel himself at any time by sending an email from the registered address to the following address: assistenzaclienti@mypass.cc. In case of cancellation, the Annual Fee paid will not be reimbursed; the cancellation does not entail the termination of payments still due for services or goods purchased in the meantime; the related charges will be made on the credit card registered before the termination of the relationship.
    The withdrawal is excluded for the purchase of tickets to be used on a certain day or period, or for the purchase of top-ups to be used on a specific day or period (Article 55, paragraph 1, letter b) Consumer Code) .

  7. Exclusion of reimbursements. Not transferable.

    Any reimbursement of the amount paid is excluded, except as provided for in the event of withdrawal. In particular, the reimbursement is excluded if the User does not use on time or only partially uses the ticket 9. Maintenance and malfunction of the application.

    Any change in the General Conditions will be reported to Users who registered when the previous General Conditions were in force; the same Users will be asked to accept the modified General Conditions; if they are not accepted, the User will no longer be able to access the site or benefit from the services offered by the site itself.   10. Partial invalidity

    Should any of the provisions of these General Conditions be or become invalid or ineffective under applicable law or judicial rulings, the validity and effectiveness of the remaining provisions will not be in any way affected.

  11. Processing of personal data (Privacy)

    MYPASS is committed to protecting the privacy of Users. A part of the site can be explored without having to communicate any personal data.     In order to be able to collect the fee for the services offered, MYPASS requests the credit card / prepaid card details that the user intends to register for the payment of said services and purchases. With respect to these data MYPASS can have a simple transfer role (so-called “mere conduit”) or temporary memorization (so-called “catching”) as provided for in Articles 14 and 15 of Legislative Decree 9 April 2003, n. 70 (Electronic Commerce Code). The complete data relating to the credit / prepaid cards will be transmitted, stored and stored by the Operator of the payment gateway and by the Banking Acquirer, the only subjects to have full knowledge of them in order to charge the payments indicated by MYPASS Srl on the same credit card.
